NJ MOTOR VEHICLE LAWS WHICH APPLY TO BICYCLES:

 

39:4-10 LIGHTS ON BICYCLES.

Every bicycle when used after dark shall be equipped with a lamp on the

front which shall emit a white light visible for a distance of at least five

hundred feet to the front, and with a lamp on the rear which shall emit a red

light visible from a distance of at least five hundred feet

 

39:4-10.1 BICYCLE HELMET LAW.

a. A person under 14 years of age shall not operate, or ride upon a

bicycle as a passenger, unless that person is wearing a properly fitted and

fastened bicycle helmet which meets the standards of the American National

Standards Institute (ANSI) or the Snell Memorial Foundation's 1990 Standard

for Protective Headgear for use in Bicycling.

 

39:4-10.2 VIOLATION OF HELMET LAW.

a. A person who violates a requirement of this act shall be warned of the

violation by the enforcing official. The parents or guardian of that person a

also may be fined a maximum of $25.00 for the first offense and a maximum of

$100.00 for a subsequent offense if it can be shown that the parent or

guardian failed to exercise reasonable supervision or control over the persons

conduct. Penalties provided in this section for failure to wear a helmet may

 be waived if an offender or their parent or legal guardian presents suitable

proof that an approved helmet was owned at the time of the violation or has

been purchased since the violation occurred.

 

39:4-11 AUDIBLE SIGNAL ON BICYCLES.

No person shall operate a bicycle unless it is equipped with a bell or

other device capable of giving a signal audible for a distance of at least

100 feet, sirens and mouth operated whistles are not acceptable.

 

39:4-11.1 BRAKES REQUIRED.

Every bicycle shall be equipped with a brake which will enable the

operator to make the braked wheels skid on dry, level, clean pavement.

 

39:12 CONTROL OF BICYCLES.

A person propelling or riding on a bicycle shall not ride other than upon

or astride a permanent and regular seat attached thereto, Nor shall they ride

with their feet removed from the pedals, or both hands removed from the

handlebars, Nor shall they practice any trick or fancy riding in a street. No

bicycle shall be used to carry more persons at one time than the number for

which it is designed and equipped.

 

39:4-14 HITCHING TO VEHICLES PROHIBITED.

No person riding upon any bicycle, coaster, skates, sled, or toy vehicle

shall attach the same or themselves to any streetcar or vehicle upon a

roadway and no operator of any streetcar or vehicle shall knowingly allow any

person riding upon a bicycle, coaster, skates, sled or toy vehicle to attach

the same or themselves to the streetcar or vehicle.

 

39:4-14.1 RIGHTS AND DUTIES OF PERSONS WHILE RIDING BICYCLES.

Every person riding a bicycle upon a roadway shall be granted all of the

rights and shall be subject to all of the duties applicable to the driver of

a vehicle by chapter four of of title 39 (M.V.Law) revised statutes and all supplements thereto.

Regulations applicable to bicycles shall apply whenever a bicycle is operated

upon any highway or upon any path set aside for the exclusive use of bicycles

subject to those exceptions stated herein.

 

39:4-14.2 RIDE TO THE RIGHT SIDE OF THE ROADWAY.

Every person operating a bicycle upon a roadway shall ride as near to the

right side of the roadway as practicable, exercising due care when passing a

standing vehicle or one proceeding in the same direction; provided, however,

that any person may move to the left under any of the following situations

(a) to make a left turn from a left turn lane or pocket;

(b) to avoid debris, drains, or other hazardous conditions that make it

impractical to ride at the right side of the roadway.

(c) to pass a slower moving vehicle;

(d) to occupy any available lane when traveling at the same speed as other traffic;

(e) to travel no more than two abreast when traffic is not impeded.

Persons riding bicycles upon a roadway may travel no more than two

abreast when traffic is not impeded, but otherwise shall ride in a single file

except on paths or parts of roadways set aside for exclusive use of bicycles.
